Description

Drug courts help reduce recidivism and substance abuse and increase an offender’s likelihood of successful rehabilitation through early, continuous, and intense judicially supervised treatment, mandatory periodic drug testing, community supervision, and appropriate sanctions and other habilitation services. A drug court is a specially designed court calendar or docket as well as a specialized court program. Drug courts funded through the Bureau of Justice Assistance’s (BJA) Drug Court Discretionary Grant Program are required by law to involve only nonviolent offenders1 and must implement an adult drug court based on the 10 key components as described in the BJA and National Association of Drug Court Professionals’ publication: Defining Drug Courts: The Key Components. Indian tribal governments seeking drug court funding should review the publication Tribal Healing to Wellness Courts: The Key Components. Additionally, drug courts funded through this grant solicitation must operate an adult drug courtwhich imposes graduated sanctions that increase punitive measures, therapeutic measures, or both whenever a participant fails a drug test and must include diversion, probation, or other supervised release involving the possibility of prosecution, confinement, or incarceration based on noncompliance with program requirements or failure to show satisfactory progress. The Resource Guide is designed to act as a companion document to the solicitation.
